1. Our contract
All bookings are made with the travel agency Hike and Bike Travel Agency S.L.. By contracting a trip with us you will be deemed to be accepting these Legal Conditions (which constitute a complete agreement between you and us) and we will accept your booking on this basis. The services to be provided are those referred to on your confirmation invoice.
2. Confirmation of booking and final payment
If we accept your booking, we will issue a confirmation invoice. A contract will exist between us from the time we issue such confirmation invoice or if you book within 7 days before your departure date, the contract will exist when we accept your deposit. Please refer to your booking confirmation invoice for details of final payment. Payment of the balance of the tour price is due 46 days before the departure date. If this payment is not made on or before the due date, we reserve the right to treat your booking as cancelled.
Your booking is accepted on the understanding that you are aware of and accept the potential risks and dangers that may be involved in activities of this type and that you are physically and mentally capable of participating in the activities demanded. You are responsible for wearing the appropriate clothing and equipment as recommended in our information, and our guide, or anyone else working in association with us, is not responsible for any accident or mishap that may occur in connection with any part of the trip or services related to it.
3. Personal details
For us to confirm your travel arrangements, you must provide us with all the information required with the price of the trip. The required details include full name as it appears on passport or identity card, date of birth, nationality, passport number, date of issue and expiry of passport and any medical conditions (including allergies) that may affect your ability to complete the travel arrangements. Your booking cannot be confirmed without these details.
4. The cost of your holiday
Please note that changes and errors may occur. You should check the price of your chosen holiday at the time of booking.
We reserve the right to increase / decrease and correct errors in the advertised prices at any time before your trip is confirmed. will advise you of any errors of which we are aware and of the price applicable at the time of booking. In such cases we will be responsible for the first 2% of the additional cost and you will be responsible for the remainder. If the surcharge results in an increase of more than 10% of the trip price you may cancel your booking within 14 days of notification of the surcharge and obtain a full refund. We will not recharge bookings for travel within the validity of this document once full payment has been made (VAT is included in the total price).
5. Cancellation by the traveller
If you cancel, some or all sections of the cancellation fees will apply. Cancellation will only be effective when we receive written confirmation of the cancellation. Cancellation charges are as follows:
(a) Up to 46 days or more prior to departure, 20% cancellation charge (loss of deposit).
b) 21-45 days prior to departure, cancellation charge of 50%.
c) 20 days or less prior to departure, 100% cancellation charge.
Please ask us for details of cancellation charges at the time of booking. We recommend that you take out cancellation insurance at the time of booking, which covers cancellation fees. If for any reason you leave your trip once it has started, we are not obliged to make any refunds for services not used.
6. Cancellation by Hike and Bike Travel S.L.
In the unlikely event that we were forced to cancel your holiday for reasons other than:
a) Responsibility of the client
b) Force majeure
c) Insufficient numbers to proceed with the trip (for scheduled guided trips)
We will offer you an alternative holiday of at least comparable standard if available.
In the case that the cost of this holiday is less than your original booking, we will refund the difference. If you do not wish to book an alternative holiday or wish to book a holiday that is not available, we will refund the full amount. In circumstances where the cancellation is due to reasons beyond our control, a refund will be made less any irrecoverable costs.
We are not responsible for any incidental expenses incurred because of your booking including but not limited to visas, vaccinations, travel insurance or non-refundable flights.
7. Force Majeure
Except where expressly provided otherwise in these conditions, we regret that we cannot be liable or pay any compensation where the performance or timeliness of our obligations under our contract with you is affected or slowed down, or if you suffer any damage, loss or expense of any nature as a result of “force majeure”. In these terms “force majeure” means any event which we or the service provider concerned could not, even with all due care, foresee or avoid. Such events may include actual or threatened war, riot, civil strife, terrorist activity, trade union dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events beyond our control.
8. Changes
If you wish to change from one tour to another or change your tour to a third party you must notify us at least 46 days prior to the proposed departure date. A fee of €120 per person per change (in addition to any charges imposed by hotels, operators or others) will apply. If you notify us less than 46 days before the proposed departure date the refund policy applicable to cancellations will apply. Changes to a third party will only be permitted where the new holder meets all requirements in relation to the trip, and date changes can only be made to a date within the current validity period. Changes to other agreements will incur an administration fee of €60 per booking per change. This fee will be in addition to any charges imposed by hotels, operators or others. No changes to the booking are permitted within 10 days prior to the departure date.
9. Change of itinerary
Whilst we endeavour to operate all tours as described, we reserve the right to change the itinerary of the tour. Please check our website prior to departure for the latest updates to your itinerary.
Prior to departure: if we make any major changes, we will inform you as soon as reasonably possible, if there is time to do so before your departure. A major change is considered to affect at least one day in five of the itineraries. When a major change is made, you may choose to accept the change, obtain a refund of money paid on that part of the trip only, or accept an alternative tour offered by us.
After departure: We reserve the right to change the itinerary after departure due to local circumstances or events beyond our control. In such emergency circumstances you will be required to cover the additional cost of any necessary alterations to the itinerary. Please note that we are not responsible for any incidental expenses you may incur as a result of the itinerary change such as visas, vaccinations or non-refundable flights.
10. Age and health requirements
General Minimum Age Policy: For most of our tours the minimum age for children is 12 years. All travellers under the age of 18 must be accompanied by an adult who is responsible for the day-to-day care of the child. Please note that we cannot guarantee triple or adjoining rooms for families; accompanying adults may be asked to share with other members of the group in twin rooms.
General Maximum Age Policy: For most of our tours we do not have an age limit, although we remind you that our tours may require physical exertion and a self-assessment form will be required for all travellers over 70 years of age. We can provide details of mandatory health requirements; but in any case, we are not medical experts. It is your responsibility to ensure that you have appropriate and detailed medical advice at least two months prior to travel on the latest health requirements, recommendations for your destination and costs. If you fail to do the above and are not allowed to enter any country or suffer injury or death as a result, we will have no liability to you for any costs, loss or damage you may have suffered and will not reimburse you for the cost of any part of your travel.
11. Small groups and package tours
We guarantee the departure of our trips when we have a traveller who has paid the full cost of the trip, unless otherwise specified in the minimum group. This means that we can sometimes have small groups. Many of our trips are designed to fit in with other departures to create a longer combined trip; this means that some members of your group may have previously been travelling together when you start your trip. If you would like to know how many people have booked your trip or if it is part of a package tour, please ask us before booking.
12. Passport and visas
We will do our best to assist you in finding and arranging the necessary travel arrangements. In any case, you must carry a valid passport and have obtained all appropriate visas, permits and certificates for the countries you will be visiting during your trip. Your passport must be valid within six months of travel. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip. We cannot be held responsible if you are not allowed to enter a country due to lack of the correct passport, visa or other documentation.
13. Travel insurance
Travel insurance is compulsory for all travellers and must be taken out at the time of booking. Your travel insurance will provide cover for personal accident, death, medical expenses, and emergency repatriation with a recommended minimum cover of US$200,000 for each of the categories covered. We also recommend that it covers cancellation, restrictions, personal liability and loss of baggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to participate in the trip without it. If you obtain travel insurance through us you acknowledge that you are satisfied with the level of cover we provide.
14. Responsibilities
On the booking form, you accept that the Bicycle Tours trips are classified as a risky sport requiring specific physical conditions, as well as the characteristics of the routes and their difficulties.
We accept liability for any negligence of our staff or agents which may cause death or physical injury to persons or loss of or damage to personal property to the extent provided by applicable law. It is our obligation, and that of our suppliers of any services or facilities included in your holiday, to ensure the provision of such services and facilities (this acceptance of liability is subject to the clause below).
We will not be liable for any damage or loss if the failure to perform the contract is:
– Attributable to you
– Attributable to a third party unrelated to the provision of the contracted services and where the event is unforeseeable and unavoidable.
– Due to an unforeseen and unusual circumstance beyond our control, the consequences of which could not be avoided even if all necessary precautions had been taken.
– Due to political disputes, border closures, visa denials, industrial action, weather or other problems of a similar nature and other force majeure.
– Due to an event that the company, even with all necessary precautions, could not foresee or prevent.
Except in cases involving death, injury or illness, any liability is limited to a maximum of three times the amount paid. In case of property damage, liability is limited to a maximum amount equal to the amount paid by or on behalf of the property owner. In all cases, the company specifically excludes all liability for consequential or indirect loss or expense including loss of profit and in all cases our liability shall be limited in accordance with and/or in identical manner to the contractual terms of the companies providing transport for your travel arrangements.
15. Optional Activities
Optional activities not included in the price of the trip do not form part of the trip or this contract. You agree that any assistance provided by our tour leader or local representative in arranging optional activities does not make us responsible for them in any way. The contract for the provision of such activity will be between you and the activity provider.
16. Complaints and grievances
If you have any complaints or are unhappy with any aspect of your trip, please inform your guide or our local representative at the time so that they can try to rectify the problem. If the matter cannot be resolved locally to your satisfaction and you wish to make a complaint you should email or telephone Trek and Ride at that time so that we can try to rectify the situation. If you are not satisfied in this way you must make a written complaint within 30 days of the end of the tour. If you do not follow these instructions, we will not accept any responsibility for the matter giving rise to your complaint, as it was impossible for us to resolve it immediately or investigate it at the appropriate time.
17. Redistribution
In the case that any of the terms or conditions contained in this contract shall be void or unenforceable by operation of law or contrary to public policy or otherwise, such term or condition shall be deemed severable from this contract or be modified so as to allow the remaining terms and conditions to remain valid and binding.
18. Photographs and marketing
You consent that we use images of you taken during the trip for advertising and promotional purposes in the medium of our choice. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for advertising and promotional purposes.
19. Privacy Policy
Any personal information you provide to us may be used for purposes associated with the operation of the trip or to send you commercial promotional material relating to our events and special offers. Information may be disclosed to our agents and suppliers in order to enable us to operate the trip. In all other cases we will treat your data in accordance with our privacy policy (available for consultation on our website).
20. Legislation
The laws of Spain govern these conditions to the maximum extent permitted. Any dispute relating to the trip or these conditions must be brought in the Spanish courts.
